Toshi Futamata is a senior researcher and recognized authority on Standard Essential Patents (SEPs) and licensing negotiations. With over a decade of experience, he specializes in strategic SEP management and practical training in IP negotiations, equipping professionals with essential skills to navigate the global IP landscape. Since 2013, he has chaired the SEP Expert Group (Japan) and contributed significantly to academic and professional training. He served as a Senior Visiting Researcher at the University of Tokyo’s Institute for Future Initiatives (2013–2025), and as a Tutor for the university’s Strategic Task Force Leader Training Course (2014–2024). He has also been a Visiting Researcher at the Mitsubishi Research Institute since 2014.

東京地裁SEP専門調停開始 Tokyo District Court Launches SEP Mediation: Feasibility and Challenges

Jan. 29, 2026 by Toshi Futamata 東京地方裁判所は、2026年2月1日より標準必須特許（SEP）紛争に特化した専門調停制度を導入する。この専門調停制度については日経新聞（1月29日付）、英国業界誌ManagaingIP (1月22日付）も報じている。過去実績の低調と背景 2014年のApple対Samsung大合議判決以降、東京地方裁判所のSEP訴訟は、Pantech対Google（2025年、Pixel 7販売差止初認定）、同対ASUS事件等に限定される。この低調は、2014年判決でライセンス取得意思を有する実施者に対する差止請求の権利濫用認定基準が定着した影響である。新制度の枠組み調停委員会は、知的財産部裁判官1名およびSEP実務に精通した専門家2名（注1）から構成される。手続は原則3回の調停期日で完結するよう設計されており、 • 第1期日：事前書面提出後の個別聴取および対案指示、 • 第2期日：技術的論点説明または調停案提示、 • 第3期日：最終意思確認による成立・不成立判定、を予定する。目標期間は約半年であり、SEP保有者のグローバルポ...
