Toshi Futamata is a senior researcher and recognized authority on Standard Essential Patents (SEPs) and licensing negotiations. With over a decade of experience, he specializes in strategic SEP management and practical training in IP negotiations, equipping professionals with essential skills to navigate the global IP landscape. Since 2013, he has chaired the SEP Expert Group (Japan) and contributed significantly to academic and professional training. He served as a Senior Visiting Researcher at the University of Tokyo’s Institute for Future Initiatives (2013–2025), and as a Tutor for the university’s Strategic Task Force Leader Training Course (2014–2024). He has also been a Visiting Researcher at the Mitsubishi Research Institute since 2014.

（研究会発表資料）英独編 SEP litigation in UK and Continent(EU, DE)

SEP研究会11月例会資料 SEPについて重要な展開が続く英国、EPC、ドイツの動きについて、 1）英国Bird＆Bird法律事務所のRichard Vary英国弁護士・日高誓子英国弁護士から”How UK courts are reshaping global SEP litigation through interim license declarations and ASIs”のプレゼンテーションで議論の沸騰するinterim license, ASIの動向と、さらに 2）ドイツWildanger法律事務所のSoenke Fockドイツ弁護士からFRAND/SEP litigation developments at German national courts and at the UPC" について講演をいただいたので、その発表資料を掲載させていただく。。

欧州議会でのSEP法案を巡る対立深まる　EU SEP Regulation battle escalates in EU Parliament

欧州議会は、11月25日欧州委員会が従前に行なっていた「SEP規制法案SEP Regulationsの撤回決定」に関して、欧州司法裁判所CJEUへの提訴を行うべしとする票決を僅差で可決した。欧州議会　　　　賛成(撤回を非難)　 334 　　　反対(撤回を支持) 　294 　　　棄権　　11 これまでの動きを振り返ると、SEP法案を巡り権利者実施者など関係者間の対立が長期化する中、欧州委員会は2025年2月のワークプログラムからSEP規則案の撤回を発表し、同7月には正式に「合意の見通しが立たないため取り下げると」と表明し、欧州委員会の公式文書でも撤回が明記された。欧州議会の賛成派は、欧州委員会が不十分な説明のまま、SEP法案を作業プログラムから撤回したことは法的に誤りであると主張している。 CJEUでの判決は早くとも2027年と見られるが、SEP規制法案を巡る対立への新たな火種となった。
