本日（7月26日）、経済産業省に於いてこれまで5回行われてきたSEPライセンス交渉を議題とした研究会の中間整理報告書が公表された。https://www.meti.go.jp/shingikai/economy/patent_license/20210726_report.html
今回公表されたのは報告書概要の和文と英文、そして報告書の資料編（全95頁）の３つの資料からなる。

経済産業省は、「標準必須特許のライセンスを巡る取引環境の在り方に関する研究会」における検討結果を整理し、今後の検討の方向性を示した中間整理報告書を策定しました。
近年、標準規格の普及や当該規格に必要な技術の複雑化により、標準必須特許（SEP：Standard-Essential Patent）のライセンスに関する紛争が世界各国で生じています。特に、あらゆる製品（モノ）がコンピュータとなり、取得・共有された情報（データ）を処理することで新たな付加価値を生み出す第四次産業革命が進展する中、今後、自動車、建設機械、工場といった我が国が強みを持つ産業分野を対象とした異業種間でのSEPのライセンス取引が増加していく見込みです。このため、当該紛争を円滑に解決する手段を検討することは、我が国にとって極めて重要な課題と考えられます。
このような状況を踏まえ、経済産業省競争環境整備室・知的財産政策室では、「標準必須特許のライセンスを巡る取引環境の在り方に関する研究会」を開催し、本分野の有識者や産業界の参画の下、SEPのライセンス交渉を巡る国際的な情勢を整理するとともに、我が国として望ましい対応策の検討を行いました。 本報告書は、上記研究会第1回会合（2021年3月12日）から第5回会合（2021年7月12日）における検討結果を整理し、今後更なる検討を進める上での方向性を示したものです。
経済産業省は、本報告書を踏まえ、SEPのライセンスを巡る取引環境の整備に向けた政策の検討を進めてまいります。
