(欧) EU新SEP法制(4) 新ドラフトと主な意見から Amended Draft reg. and opinions

欧州委員会EU-DG-GROWからの新SEP法制化案については正式発表を前にドラフトがリークされ、そのradicalな内容からSEP関係者に驚きを与え、数多くのブログ発言や報道が溢れている。日本の関係者の間ではどう理解してゆくべきなのかという戸惑いの声も聞かれる。

リークされたドラフト２本については明日26日に欧州委員会から発表があるという観測であったが、ドラフトにさらに修正が加わっている様子で明日予定通り発表されるかどうかは不透明である。今回あらたにリークされた３本目の文書（47ページ）についてリンクを紹介する。まだ筆者は照合を終えていない。

ただ一点、FRANDレート確定作業中の９ヶ月訴訟禁止条項については現在EUがWTOに中国のASI（禁訴令）を提起しているが、それとの矛盾の批判が多いため、同条項が今回のAmendmentから消えていた。

なお今回はこれまでの多くのブログ発言のうち、いくつか反対意見のなかから注目された二つだけ紹介する。

• ETSI（標準化団体）の反対意見書

ETSI代表（Director-General)のLuis Jorge Romero Saro氏がSEP登録制度と必須判定のあり方について強い懸念をしめしている。

4月19日付　“The European Commission can achieve its goals without putting European participation in future standards at risk. Will it?” published a thoughtful LinkedIn article

ドラフトはWTOでEUが中国のASIを批判していながら、それと同じことをEUが行おうとしていると批判する。
