３月３１日にSEPライセンス交渉に関するガイドラインが経済産業省から発表されたが、その後の海外報道が２誌に出たので紹介する。ともに有料誌であるが、Mlex誌についてはこの記事をEditor’s Pickとして全文公開いただいている。

”Good faith guidelines for SEP licenses”として短い5ページの指針が出された。英語訳もついている。
ガイドラインは法的拘束力を有さないこと
交渉の４ステップについての行動についてのガイドを定めている
パテントプールはガイドラインの対象外であるが、より透明性の確保を求めている
概してパテントに詳しくない関係者むけのものであろう
以前言われたきた内容よりはよりバランスのとれたものとなっている。

経済産業省は、標準必須特許のライセンス交渉の透明性・予見可能性の向上を通じて適正な取引環境を実現するため、我が国として、国内特許を含む標準必須特許のライセンス交渉に携わる権利者及び実施者が則るべき誠実交渉の規範を示すものとして、「標準必須特許のライセンスに関する誠実交渉指針」（誠実交渉指針）を公表しています。
