中国国務院 独占禁止委員会（国務院国家市場監督管理総局傘下）が、意見募集などの手続きを経て改訂を重ねていた「国務院独占禁止委員会による知的財産権分野の独占禁止ガイドライン」が2020年9月18日に発表されていたことが判明した。発表文書を見ると昨年2019年1月4日にバックデートして公布となっている。
特にSEPについては第27条に詳細に記載されており、SEP保有者の独占禁止行為を認定する基準を記載している。この基準によれば、先般のHuawei v. ConversantではHuawei主張が認められるように読める。JETRO提供の日本語訳と原文のリンクを載せる。

中国、知的財産権分野の独占禁止ガイドラインを発表
国家独占禁止委員会はこのほど、昨年1月4日に成立させた「国務院独占禁止委員会による知的財産権分野の独占禁止ガイドライン」を公布した。
独占禁止と知的財産権保護は、競争保護と革新激励、経済運営効率の向上、消費者利益と社会公共利益の保護という共通の目標を持つ。中国の「独占禁止法」によると、経営者が知的財産権関連の法律、行政法規の規定に基づいて知的財産権を行使する行為には、「独占禁止法」を適用しないが、経営者が知的財産権を濫用し、競争を排除、 制限する行為には、「独占禁止法」を適用する。
同ガイドラインは、知的財産権濫用行為の「独占禁止法」適用にガイドラインを提供し、国務院の独占禁止関連機構による法執行の透明性を高めるために、制定されたもの。内容は、▽総則、▽競争を排除、制限する可能性がある知的財産契約、▽知的財産権に関わる、市場での支配的地位の濫用行為、▽知的財産権に関わる事業者集中、▽知的財産権に関わるその他の状況——の全5章28条からなる。

(xxvii)Special issues involving Standard Essential Patent
Standard Essential Patent (SEP) is the patent essential to the implementation of certain standards. Determination whether business operators with SEPs occupy market dominant positions shall comply with Article 14 of this Guideline as well as taking the following factors into consideration:
1.The market value, and the scope and degree of application of the standard;
2.Whether there exists substitutable standards or technologies, including the possibility and transformation cost of applying the substitutable standards or technologies;
3.The degree of dependence of the industry on related standard;
4.The evolution and compatibility of related standards;
5.The possibility of related technologies within the standard being substituted.
