欧州委員会 SEP Expert Groupセミナー（第2回）開催 2nd. SEP Expert Group Webinar held on Mar.23.

欧州委員会の主催するSEP Expert Groupのセミナー第2回が3月23日開かれた。

第2回のテーマは”FRAND Licensing & valuation. Which are the key principles and how to render them more operational?”というテーマのもとオンラインで欧州を中心に600名のSEPに関連する専門家が集い開催された。欧州中心の会議であるが、米国(Qualcomm), 中国（小米）なども参加したほか、日本からも数名の参加があった。

セミナーは３つのセクションからなり、Round1ではN.D.に関する議論、Round2ではライセンス契約が非公開のなかでFRAND条件（とくにValue)を決める上での困難についての議論、Round3では”access to all” vs. “license to all”についての議論がなされた。

また、今回の3時間半番組の冒頭のキーノートスピーカーには日本が特許庁が特別招待され、2年前に出したSEPライセンス交渉の手引きについて、2年後の状況、さらに特許庁が考案し導入した判定制度がどうなったのかなどが話された。スピーカーは企画調査課課長補佐天野氏。

特許庁天野氏のプレゼンテーションの中心は手引きに関するものだったが、紹介された判定制度については、利用されていない理由についてチャットで複数の質問が寄せられるなど、日本の動向についての関心が高いことに驚かされた。コロナ禍でも、欧州では毎週のように各国の裁判官や企業担当者が参加するWebinarが開催されている。各国や各企業が自らに有利なルールメイキングを実現すべく凌ぎを削る中で、日本の産官が継続してグローバルな議論の場で発信し続けていくことの重要性を改めて感じた。
