（中）Lenovo v. Nokia 深セン中級人民法院 ASI判決文公開 Lenovo v. Nokia ASI judgement published by Chinese SPC

• 中国企業を巡るASI（禁訴令）事案は進行中のものを含め10件あるが、そのなかで中国企業が申し立てたASIが却下された唯一の例がLenovo v. Nokiaである。Lenovoは堺最大規模のPCメーカーであるが、NokiaがH.264のライセンスを巡って係争となり、全世界で訴訟拡大となった事案である。中国では深セン中級人民法院で昨年1月27日の判決であったが長らく判決文が公開されていなかった。今回本年3月9日最高人民法院から公開されていることが判明した。

• 事案：深セン中院でLenovoが行為保全措置としてのASIを申し立て（2020-10-13),　深セン中院が申立却下(2021-1-27)

• 背景：NokiaとLenovoはH.264を巡って世界中で訴訟となっており、訴訟地はドイツ（ミュンヘン、デュッセルドルフ、マンハイム、カールスルーへ）、インド（ニューデリー）、ブラジル（リオデジャネイロ）、米国（N.C.DC, ITC)であった。

• 深セン中院が却下したのは、各地での訴訟係属中のなかLenovoにとっても逆の結論となる可能性もあり、ASI（禁訴令）を出すことの合理性がないことを理由としている。

• なお、両社は2021年4月に和解にいたっている。

Chinese Court published the full text of ASI ruling in Lenovo v. Nokia

Recently, the Intellectual Property Tribunal of the Supreme People’s Court published the Anti-Suit Injunction (“ASI”) decision issued by Shenzhen Intermediate People’s Court (“Shenzhen Court”) in the SEPs license dispute between Lenovo and Nokia, where Shenzhen Court rejected Lenovo’s ASI application against Nokia. I. Timeline for the ASI decision

On October 13, 2020, Lenovo filed a lawsuit against Nokia before Shenzhen Court for the SEPs license dispute over H.264 standard, in which Lenovo asked to the court to (1) require Nokia to immediately stop Nokia’s non-FRAND behaviors in the license activities concerning Nokia’s H.264 Chinese SEPs, (2) determine the FRAND royalty for Nokia’s H.264 Chinese SEPs, and (3) require Nokia to bear the reasonable cost and the litigation cost.

On November 26, 2020, Lenovo filed a behavior preservation application before Shenzhen Court and required Nokia not to enforce any decision or judgement requiring Lenovo to stop the infringement that may be issued in the infringement litigation proceedings before Munich District Court, Mannheim District Court, Karlsruhe Court of Appeal, Dusseldorf District Court, Delhi High Court, Rio de Janeiro State Court and any other courts, before the delivery of the final effective judgement of this case. At the meantime, Lenovo provided CNY 20 million for guarantee.

On January 27, 2021, Shenzhen Court issued the ASI decision and rejected Lenovo’s application.

II. Reasonings of Shenzhen court

Shenzhen Court denied Lenovo’s application, as the court believed that “all the above-mentioned foreign proceedings are pending, and Lenovo could be in favor in these proceeding or these disputes could be settled through mediation. In other words, there is no decision or judgment from foreign courts at this stage which can be applied for enforcement by Nokia and can cause adverse effect on Lenovo’s rights and interests. As a result, the court cannot determine Lenovo’s application in accordance with laws and regulations concerning behavior preservation. Thus, the application of Lenovo shall be rejected”.
