（欧州）TFEU101条に係る欧州委員会の意見募集締切せまる Stakeholder consultation on the review of the TFEU Article101

EU機能条約101条の一括適用免除規則に関する意見募集
欧州における競争法であるEU機能条約（TFEU, Treaty on the Functioning of the European Union）第101条は競争又は加盟国間の取引に影響を及ぼす協定/協調的行為を禁ずる。第101条１項には免除規則があり、競争を不条理に歪めない限り、当該行為が経済利益を生み、その利益が少なくとも部分的に消費者に還元され、競争の制限なしでは当該利益を得る事が出来ない事を示すことを条件として禁止されないと規定されている。欧州委員会は過去にいくつかの一括適用免除規則を定め、特定された条件を満たす協定が免除されてきた。
免除規則には研究開発一括適用免除規則（R&D Block Exemption Regulation、略してR&D BER）と専門化一括適用免除規則（Specialization Block Exemption Regulation）があり、両者をあわせてHorizontal Block Exemption Regulations、略してHBERと呼ばれる。さらにHBERには水平的ガイドライン(Guidelines on the applicability of Article 101 of the Treaty on the Functioning of the European Union to horizontal cooperation agreement, 略してHorizontal Guidelines)が付随する。
今回の意見募集の対象は上記に対するものである。本年7月より意見募集（アンケート形式）が行われている。締め切りが10月5日と迫る。回答にあたっては部分回答も可能である。アンケートのリンクは：https://ec.europa.eu/info/law/better-regulation/have-your-say/initiatives/13058-Horizontal-agreements-between-companies-revision-of-EU-competition-rules/public-consultation_en
アンケートは全部で145問あるが、標準化に関する部分(p.47以下)がSEPに関係する部分で、Q95-105の質問が該当する。

Q104＆105：LNGなどのグループ単位でライセンシング交渉の経験について質問

Article 101(1) TFEU prohibits agreements and concerted practices that affect competition and affect trade between EU Member States. Article 101(1) TFEU has an exemption from this prohibition where it can be demonstrated that the arrangement produces certain economic benefits and some of these benefits are passed onto end users; the restrictions of competition are indispensable to achieve those economic benefits and competition is not unduly distorted. The European Commission have adopted a number of block exemption that grant exemption to certain types of agreements which meet set conditions.
The present public consultation concerns the R&D Block Exemption Regulation and the Specialisation Block Exemption Regulation - they came into force 1 January 11 and will expire end of 2022. There are accompanying guidelines to the HBER in relation to horizontal cooperation agreements which are also being revised and updated.
