EU 中国のSEPグローバル料率設定をWTO提訴 EU files WTO complaint against Chinese SEP global rate setting

欧州委員会は1月20日WTOに対して、中国が当事者双方の合意のないまま、中国特許のみならず海外特許もふくめSEPのグローバル料率を設定し、それらを当事者双方にBindingとして押し付け、結果としてヨーロッパの技術に安価にアクセスする「不公正かつ違法な」違法な慣行が行われていると指摘した。これはWTOルールに反するとしてComplaintを発出した。今後2カ国間会議が60日以内に解決に至らない場合には訴訟段階に移り、パネルが設置される。

R&D is an engine for innovation that ensures EU leadership in developing future technologies, and it needs to be properly rewarded. We challenge these unfair trading practices at the World Trade Organization.

これまで中国がSEPのグローバルレートを設定できることを判示した最高人民法院判決は以下の３つ。
2021年8月 最高人民法院、OPPO vs シャープ、グローバルライセンス料率に関する管轄権について判示
2022年9月 最高人民法院、OPPO vs ノキア、5Gグローバルライセンス料率に関する管轄権について判示 ※2023年12月 重慶市第一中級人民法院が当該ライセンス料率を判示（その後和解）
2024年1月 最高人民法院、OPPO vs ACT、SEPのライセンス料率を判示
今回、欧州委員会としては具体事例として2G,3G,4G, 5Gを巡る重慶法院判決を指摘している

”CHINA’s COMPLIANCE WITH ITS OBLIGATIONS UNDER ARTICLE 63.3, SECONDSENTENCE, OF THE TRIPS AGREEMENT
